CONSUMER RIGHTS & PROTECTIONS

Consumer protection law strives to protect against fraudulent, deceptive, and/or unfair trade practices in the marketplace. A broad array of federal and state regulatory devices have been implemented to protect the public in a multitude of industries, and entire bodies of regulation such as “elder-abuse” laws have been put in place to protect high-risk groups.

Within individual industries, specific consumer protections often exist, such as consumer lending regulations, advertising regulations, and product safety regulations.

Antitrust and trade regulations also benefit consumers by protecting the marketplace as a whole – by promoting fair competition among manufacturers, sellers, and other market participants.

Product liability law also serves an important consumers protection function. The fear of lawsuits acts as an incentive for manufacturers and merchants to improve the overall quality and safety of goods in the marketplace.

Attorneys play an important part in the enforcement of consumer protection laws. Consumer rights involve matters of significant public interest, and lawyers are private enforcers of those important rights. With public-policy in mind, many consumer protection laws include attorney fee provisions which facilitate enforcement of consumer rights in situations where the victim of a violation could not otherwise afford to litigate the issue.
